Another forum bites the dust...

The forum for hot rodders and kustomisers based in W.A. Has had to close it's doors.

There was some argy bargy regarding the treatment of entrants at a big corporate show. Then the writs started.


Hopefully they will follow suit and use the system that HRI used to reopen after it was shut down. Namely, host the site OS and make the administrators nameless Americans - they cannot be held liable for freedom of speech issues including not have responsibility for defamation proceedings.

(Details of this water-tight legal solution to the law suit problem have been provided to a few "admins / moderators" here but they will probably wait until too late too)


WA Volksrodder may know a bit more, being a sand groper he spent more time on there than my occassional visit.

Theres always the few that stuff it for the majority. Why can't some just cop it on the chin and get on with it?

Especially when the legals are piss and wind...
But just gettign past that to the point of showing them they haven't a leg to stand on costs a small fortune.

At least now there are nation-wide sensible defamation laws...

■ Damages capped at $250,000

■ Truth alone is a defence

■ No "public interest" requirement

■ Offer of amends introduced

■ One-year time limit to sue

■ Companies with more than 10 staff cannot sue



But the forum itself can be protected by setting up the same way the rodders did after their legal quandry.

Now for some more idealism.

I call it the David and Goliath Rule.

In a case where two people go to court over something, the largest amount of costs which could be granted to the winner would be the smallest amount of legal expense paid by either side.

Therefore if someone sues you , spends a huge amount on lawyers and wins, but you have only spent a few thousand, then that's all the legal costs that they get. People would go to court knowing that win or loose most of their legal costs will be carried by themselves.

So if Goliath sues David and wins then Goliath gets David's legal costs only. That would encourage Goliath to negotiate before suing. It also means that if David sues Goliath then Goliath will only spend a small amount on legal costs. Either way it would limit lawyers incomes and that can only be a good thing.
