This is what happened on my way to work last night.
I spun out on Kiama Bends (south coast NSW).
I was only doing 60 in the 80 zone and couldn't understand how it happened until i was told about an oil spill from a bus crash earlier on that day.
As i turned the steering wheel i noticed that i was still going straight, when i tried to correct it that is when it bit and flick me 180 degrees and into the armco rail.
And when the plod arrived, they said that they still had to charge me, i didn't appreciate that.
They didn't charge me there and then, but they told me to watch the mail:o
I am pissed as the car was a gift from the grand parents inlaw and it only has 62,000km on it.
A sore neck and bruised ego are the only other injuries.

For anyone that wants a slightly damaged excel for parts or repair, drop me a line it still drives fine and every thing still works ($1200).

If you can drive the car away from the scene then they dont have to charge you...

First thing tomorrow, you find out if the spill was documented, either from the RTA or the police.
If it is, take the charges to court.

Then you find out why it wasn't;
a) cleaned up, or
b) sign posted.

Then you give the RTA the bill.

yes. Although you are legally required to be in charge of the car at all times - even when spinning on oil! - and the cops are duty-bound to write to a NEG ticket, I think you wil find you have a 'case' if there were no signs

ouch indeed.. but what if no railing there.. what n where would of you ended up.. ?? :o
i agree with prevous posts re signage etc.. its all about duty of care these days and maybe the RTA had a slip up (sorry about the pun)
at least all is kinda well hey.. no one really injured and such..

I just asked a mate who is a cop, and if the car is driveable and the damage is minimal then they dont have to charge for neg driving, but because of the damage they would have had to charge you...

I never really liked front wheel drives ever since i had my 1 and only(MitsubishiCordiaGSR) whilst a nice car with plenty of poke, over correction was always a possibility had it for 3 months. Went back to a rear wheel drive.

As everyone else has stated RTA fault if signage not present.
Court case.
Try to get the needed info without revealing the fact u had an accident and plan to seek compensation as sometimes u wont get squat and paperwork about the oil spill will appear very quickly....
See a lawyer..
I have heard that these things have memory metal and the panels once heated will almost pop back into place?????
Suggestion.

they dont have to fine you even if its a right off. my sister rolled my car down an embankment. she was let off because it was an unavoidable accident. a few months later she was doing a u turn on a blind bend over double lines. got t boned. wrote off 3 cars in 6 months, all her fault and never got fined for any of it.

but I guess you arent a teenage blonde.

OK, here is an update on what is happening.

Haven't been able to get anything from the RTA.
And today i opened my letter box to find a NEG DRIVING CHARGE in the letter box just waiting for me.
$308 and no mention of points.
Though on the ticket they have mis-spelt my address on the ticket (left out a letter in the street name).
Does this give me any hope of avoiding paying these bastards (i have i high respect for the police, but this is just insulting).
I now know why people do runners, look what happens when you do the right thing.

Any one with help on this matter would be great.

If you haven't already done so, go back to the scene of the accident and take lots of photos. Especially any that can show that you didn't have chance to see the oil. You need all the ehlp you can get so take pictures that will help your case.

3 points, I'll tell you that for nothing. This is what they hit my young bloke with on good Friday. Same charge, same fine, so you can bet it's the same points.

If the RTA wont talk to you go to the cops. If it was a bus crash, they will have a report on it. Failing that, look to your local paper, see if they have something on it.

Yeah neg driving is a bit rude, i also put a car down a 20ft embankment, not able to drive and did 6k damage but didnt get charged...road had to be closed to pull the car up and cops, fireries and ambo was there...

as for the mistaken spelling on the ticket i had a similar angle on an unrelated offense (speeding) went through the motions,
letters back n forth with the traffic branch but in the end they said that the majority of the data on the ticket was correct so the fine could be warranted..
still did give a good stall tactic for about 3 months though..
good if you need some points up by then hey..

Have u seen a lawyer??
Go do it and then see if it is possible to give the RTA a bill for damage to the vehicle. If signage was not posted then it's a good bet that this can happen.

Unfortunatly this isn't as easy as it sounds with the military.
