annoying... very annoying!


My landlord (that lives in the house next door to my block of flats) has just told me to park my car on the street when i get home from work at night, because its too loud and wakes her up... (actually, first she told me i should go and get my car fixed because its too loud, then when i told her thats what its supposed to sound like, she got pissed off and told me to park it on the street)

Living in west end, its not particularly a good idea to leave your car outside on the street if you dont have to because 1) you are assured of a parking fine seeing youre parked in the brissy CBD, to avoid the fine you have to get a parking permit which costs who knows what amount of $$ per year, and 2)If it doesnt look fast enough to nick, idiots will want to it damage anyway, and theres certainly alot of idiots around...
Now I have a perfectly good garage i can park it in under my flat, ive been living there over 3 years and none of the other people living in the 2 other flats have complained about noise since i have had my beetle (around 4 months).

I personally think this is very very rude of her seeing that i had to complain, send letters and complain again and again about the neighbours in the house next door to the flats (she owns that house next door to our flats) about their incessant noise and inability to shut up at 3am... (nothing was done of course, because they paid more rent that i do....*grrrrrrr*)

I drive the car down the driveway and into the garage and it takes less than 2 minutes all up... but its obviously grounds to pick a bone with me because of such and such reason....

just wondering if any other flat dwellers with a VW have had complaints about their cars noise, and how you dealt with it. I just dont think its fair that i should park it on the street, which would make it almost impossible to get insured, and is not very safe!
Will i really have to push it into the garage every night??!!??

This sounds a bit similar to The Bronze's difficulties before he moved to Dubbo.

If I were you, I'd be checking with the Tenancy Tribunal (or whatever they call it in your state) to see what rules/regulations exist regarding noise.

I would have thought that if your car is not getting picked up by the EPA for noise pollution, and you are not making unnecessary noise when you drive in/out, then you would be within your rights to drive in and out of the garage you obviously pay for. :)

I don't have that problem as I live on acreage,but a friend down the road about 500mtrs as the crow flies ,reckons he can here mine start up,and sometimes I can hear his. How would your land lady like a Harley rider instead ?. Or better still tell her your going to get one ,he he he he

i think you would find that if your car is not in breach of the epa, then she can do nothing about except evict you when your agreement is up. she certainly can not evict you for owning a car that is not in breach of anything. you could argue that no problem.

maybe she is just looking for a reason to get to know you better.........;)

hey tell us more , is your car standard ?
Have you got extractors and hot dog.?
I'm just thinking maybe to give a little bit , maybe you could whack an end baffle on till you drive to the street then remove it.
Surely when you get home its not a problem.
Just the early morning starts.
Of course I'd be annoyed to have someone put my car at risk.
So i'd be inclined to try to find comprimise, and explain why you cant leave it on the street.

i had a tennat that was into launching vodka bottles of the front verandah into the garden and used to get the police around for certain parties, un invited of course.... so i have an idea.

also, i have a harley that has straight cut pipes. so i've been on both sides.:cool:

Hi Star Buggy - I was in the same sort of situation a while back, now I have a neighbour with so many cool toys he would rather use on my Baja than his two Range Rovers. Him and I airbrushed the engine, gearbox and rear third of the car over six hours two weekends ago. Cool neighbour now but previously I lived at a strata title and I had a heap of probs.

My previous and new Bajas were both unregistered. I was daily repairing the Dog-O-War (71 Baja) for rego when the strata decided (after 2 years of VW's in the carport) that they didn't want it there anymore. Unfortunately they were quite within there rights to have it moved out by fining me $500 a week until I moved it. Remember this is a strata - much different to a normal rental. Anyhow, with some help from Azza around at his place it was registered within three weeks and there was nothing they could do. It passed the noise, tyres, belts, panels, cage etc. So legally it was permitted into any public and private space. The strata was heaps pissed and my other nieghbours cheered when it came in with plates on, rattling all the committees windows on start up each morning. With twim shotgun hotdogs straight through out the rear it never went unnoticed when the Bronze was coming home. As a coutesy to other neighbours I would shut the motor down when coming in at 3am after work. Climbing the hill on the way out was a different story so if I had a early moring shift I would park it outside a committee members house at the top of the hill.

If I were you I would total up the cost of the extra insurance, the parking cost and add 15% for miscellaneious dammage / theft and ask her to reduce your rent by the annual amount, then you would be prepared to park it on the street. This way you have negoitated a fair deal, made a motion of compromise and have offered for her to make the next move. If you have to go to a tribunal then you can claim that you have offered a fair solution on such and such terms at this given date and it was declined etc.

Legally - she cannot tell you where to park, and in her position there is no easy way to say "Your car is too loud". I think a compromise is the best way and to be seen as making an effort to minimise the noise - e.g. = tune it up the street or at a park somwhere, warn it up up the street, coast it in with the engine shut off during the wee hours and let all the other neighbours know you are being thoughtful or there confort.

It's been said already. If your car is legal, then she hasn't got a leg to stand on....unless you let it warm up at 3 am in the morning! If she does get narky, and threatens eviction, you could actually take her to an equal rights board - if it gets that far. You have every right to park your car within the complex, especially if parking is part of your rental agreement. So long as you're a good tennant otherwise, and don't trash her joint [which could be a good revenge], then the worst she can do it not renew your lease.

Thanks for all the suggestions! I think the turning engine off and rolling it into the garage (provided that the new neighbours next door dont have a huge-ass car and park me in) will probably be the go, even though its going to be annoying as hell at 11:30 at night! I thought of trying the park on street/rent reduction compromise, The Bronze, but thought better of it because i can tell you now, shes not one for compromise :(

The beetle has been modified, extractors etc, but its still within noise limits, so she cant really say S**t...

I think once the lease is up, if anything better is around, i might have to take it! Im sick of all her bullsh*t and whinging and stealing my tomatoes and cucumbers out of my garden... (thats another story...)

what sort of motor and muffler do you have?

You will find hot dogs on most engines will be illegal and too loud.

If I was you I'd probably get a quiet muffler for it.

Having said that my dogs hear me from far enough away that they can be at the end of the ~150m driveway waiting for me. :D

Starbuggy, I agree with Bronze. I think you should make the offer, even knowing that she will reject it. As Bronze said:
