Hi All,
The worst thing that could possibly happen happened to me today. I never thought someone could steep this low or be so cold. I had contacted a man
lets name him bill to buy his 54 and them sold my good white 54 to buy bills 54. I had also sold the pan to someone else in melbourne but promised the
new owner of the white 54 that he could have bills pan. The plan was all going goo and I saw bill only a few weeks ago and everything was fine. I went
down there today to pay the rest of the money off to him and he said sorry I have changed my mind and decieded to keep it. and handed me the money
back. Someone in the VOLKS ENTHUISAST CLUB in ADELAIDE had told him that it was worth heaps more than the 3000 I was paying for it and that he should
hang onto it. Now I dont know about you or me but when you have a agreement like this you stick to it, you just cant change your mind at the last
minute like that. An agreement is an agreement. It is morally wrong to do this. Not only this but the owner of the white 54 now has no pan and I have
lost a really good car and am back to square one looking for a suitable car so not only 1 of have lost out ion this deal gone sour but two of us. I
feel really bad for the new owner of the white 54 and I dont know what to say but sorry as I know you will read this. As for the club, you can go to
hell and bill the member, I also dont know what you are thinking in your head or where your heart or how you could do this to someone and sleep at
night.
So if anyone out there has a 54 pan close to october please let me know as I have to fix up the owner of the white car... as for me I am going to say
F--k it to VW's and build something else. I am that pissed off.

I feel your pain. Its not good. But dont give up on VWs. Things will be better tomorrow.
Whenever things have gone wrong for me, I put a reuqest out for the thinsg I need, and have met the most amazing group of people because of it. The
kind you just 'know' you can trust. They're not in it to make alot of money. They're in it to share the joy of VW's
Hope you find more of these kind of people soon.

what a shitter. Any car is worth what its worth to both people at the time, no more, no less what a pisser ... all because someone needed to stroke
their ego it seems.
I had similar last year on a double door panel. A total sht box in all respects, but after agreeing a price, someone told him that it was worth
telephone numbers as its ... dare I say (sorry Pete) RARE!.

Backing out of a deal because you got a better offer is lower than snake poo and twice as twisted IMHO.
Technically, since he had accepted a deposit, the contract was legally binding, but meh, could you be bothered.

Its a shame that there are such morons around. I too have found the vw community to be one of the nicest groups of guys and gals around, who are
really willing to help out a fellow dubber. This 'bill' guy is probably a johnny come lately vw fan.
Sort of like when you go to most (but not all) mk4 or mk5 golf owners and go " I used to own a mk1" and they go "whats that? did that come before
the mack 3? whats that got to do with my car" Its not a razor moron, foget it I'm outta her.

Yep, that's how to f**k two people over in one foul swoop. Don't panic man we'll sort it all out because unlike some we are reasonable people who
treat others how we in turn like to be treated...
I don't believe that its worth any more than what you were paying, for christ sake its only a rolling shell, that needs the apron stitched back on
and the full works with paint etc. Take a look at what retroresto got for his money, sure it was more but he got a restored pan, restored motor (from
memory), a body that was practically ready for paint and most of the bits like heart tail lights etc. So if the car you were getting is worth $4 or
$5K then retro got the deal of a lifetime. More like the "people" who advised bill need to have a good look at the car and what wasn't in the
deal, then take off their rose tinted glasses and come back to the real world
Obviously we have both fallen victim to the "You can't modify it, cause it's a 54" epidemic... Wake up guys, anyone seen the split window cal
lookers and resto cals coming out of the states, just because it's pre 58 doesn't mean it can only be restored. Sure don't bastardise an early
car, but tasteful reversible mods don't hurt if that's what floats yer boat. You can always remove a HP motor & box if you want to make it stock
again.
I'm also at the point where I don't really give a sh*t, either:
1. If we find a good bodied rolling shell then you take the body and I take the pan
2. If all we can find is a roller where they body is worse than the white one then I'll take the lot and you can have the white one back.
Just depends what's around for what $$
Like I said don't panic we will work something out that is good for both of us, without "bill's" help.

I sold my 54 that was running and just out of rego but complete and the only rust the size of a 20c piece for only 5k...

Don't worry? Stuff that. You had a deal and he had your cash and you got screwed. If you are that pissed off about it take him to court. No way in
hell you can loose. And even if at the end you don’t get the car you might be able to get the difference between the sale price and what they think
it is worth as technically you are out of pocket for that amount. People like this need to be taught a lesson. It's not a case of you being stuopid
and suing for it. Like tripping over a footpath.
My sister recently got screwed on ebay for $30. She took the guy to court. Sure it was a hassle but he ended up paying $250 in court cost, not to
mention his time. And the biggy, a record. Maybe if you go back to this guy and tell him that’s what you are going to do he might do a big about
face. Of course it would be different if you agreed and then he turned around and said no, with no money changing hands. Do you have a reciept for the
deposit? If so I would go for it. What do you have to loose?
This bastard will just sit on it for a while and then you will see it for sale later because again. They have still lost interest in it.

Depends how long between and deposit and refusal. Most states have a cooling off period where the deal can be cancelled.
If the seller pulls the plug, deposit is returned. If the buyer, an agreed portion of the deposit is lost.

Reckon it's a real bumber, Similar thing happened to me years ago when my eldest son and I turned up to buy a car advertised in the Saturday paper,
looked at it, said yes for the advertised price and the DH went inside to get a receipt while we counted out the money. Second bloke turns up just
before DH actualy takes our money and imediatly offers th DH more than he was asking for(without even looking at the car) in the add, DH turns to us
and says "well its your turn now " so much to my sons surprise I beat then second blokes offer while flashing some folding stuff around, eventualy I
come out as top bid about 300 more than the asking price, second bloke leaves and I send the DH inside again to make out a new receipt, I wasn't
going to let him change the first one no way, Under the car to check out some mythical thing to make DH wait a bit longer and for second bloke to
leave for sure, then out from under the car and tell DH we changed our mind, worth it to see look on DH's face and big laugh from son. WE WIN
I dream of a day when a chicken can cross a road without being asked for it's motive!

My belief of the moral meaning of a deposit is that it serves two purposes:
1. Buyer protection
A deal has been made, the terms of the sale are finalised at this point (cost, what you get, etc). The seller can't sell it to someone else. By
paying a deposit the purchase is secure from competing buyers and is irreversible by the seller as the buyer gets a bank cheque, takes loan, etc... If
you accept a deposit from a buyer then consider the deal done, unless they dont come through with the balance.
2. Seller protection
If the buyer doesn't come through with the balance within a reasonable time limit the deposit is forfeited which pays for re-advertising, etc. If the
buyer screws around and changes their mind after weeks then the seller may keep some or all of the deposit to cover costs.
Generally the time for the balance to be paid is agreed on when you make the deposit and one would expect that any change in this time would be
discussed between both parties and have good reasoning.
I have dealt with a seller changing their mind about the terms of sale after deposit paid and it is not a nice prospect. For the seller to cancel the
sale after you have made your arrangements to complete the purchase is much the same. Totally immoral in my opinion. |
