question...
if you hit someone, and that person gets their car fixed without getting quotes, and then their insurance company slaps you with a $4000 bill, is that acceptable?
please note: the prang was in january, minor damage to the rear drivers side door of a plain white ford festiva (95) and i had made several attempts to contact the guy who never made any attempt to return my calls or even tell me what was going on. im supposed to see 3 different quotes right? cos i havent even seen one!
are they allowed to get their car fixed and then just slap you with any old bill?
in the beginning, the universe was created.
this made alot of people very angry and is widely regarded as a bad move.
short answer yes, if they went to their insurers approved repairer then their insurance co will go the offender ( you ) for the money

That's right, the answer is yes.
If they wanted to they could even get an independent assessor and demand the money with no car fix. That does not happen often, but that is the case with some third party recoveries.
Scenario being, you may be ready to sell your car in a couple of weeks and all of a sudden it goes from being say a $6000 car to being one with $3500 damage. You would be well within your rights to get the money paid direct to yourself and sell the car as is damaged with no fix. Hypothectically it would mean the vehicle would now be worth only $2500 but you would be getting your full amount with the payment for the damages.
If the other person has comprehensive insurance, the insurance company can assess the vehicle with one quote and forward the damage claim amount to you. They are acting on behalf of their client.
If the other person is not going through insurance it would be fair to expect two quotes. You cannot force them to go to any particular place. At the end of the day if it is your fault they can take it to court and they will seek damages claim, win and it will cost more due to court costs.
I was lucky (Hmmmmm sorta) that Fleur catapaulted the beetle into the back of a trailer which did not get damaged. Stuffed the beetle quite a bit though. 🙁
All fixed now 🙂
I know some one paying for a two week old honda crv & 1 year old magna all because no insurance .
he is paying $12.80 for a long time !
Looking for that special lady : PM me for coffee & cake
yep you wont see the quotes, if the people want to they could i spose. Not normal though. And you certainly dont choose the repairer that is up to the victim.
<hr>"I choose to Cruze VW Golf Mk1 Style!!!"

At the very least you would be advised to get third party insurance cover. It can range from $100 all the way up to $600 depending on age and rating. It averages about $300 for someone who has their licence for a couple of years.
It is not the question. "can you afford insurance?"
it should read "can you afford not to have it?"
I dont particularly like insurance companies any more than I or most people like banks. Unfortunatley they are pretty much a part of our lives that we have to deal with.
I wont explain how but I had a $40,000 claim on third party a few years ago in Fleurs old VH Commodore. cost $400 excess and the rest was covered. I see that as well covering my insurance premiums for many years to come.
Well, I have got to say I am looking into a Mirror..
I just got a letter from a Lawyer saying PAY UP $2109.78 in 14 DAYS or we will Break your legs!!!
(Well most of that is true)
And all this for being the nice guy.. If you belive me here how is goes..
I am pulling onto MONAVAIL RD from EPPING RD (East Bound)
this is a Merge Lane and as I check my blind spot turn back round and WHOA.... She has stopped half in the merge lane and Half in the 1st lane of Monavail Road due to two or three cars passing us in lane 2 AND SHE WAS ON HER MOBILE PHONE!!! Grrrrrrr
So I get out and tell her to move up to the teft turn lane 50m further on (Still on her Phone)
We do the detail swap and I tell her that about the Legalitys of Mobile Phone and driving...
MAN I WAS NICE AS PIE
Inspected the bugger all damage and she even said "Aww do not worrie about it, I have lots of damage on the back of my car anyway, the hit did very little"
I even offered to fix her bumper if that was what she wanted....
Well I got done.. The letter is nicley itemised and I am paying for...
New Bumper (Yeah OK that is cool)
All the Steel Assy under the bumper, all the parts left and right (I hit the left corner, only just)
Tail light (HUH, Did not touch that)
Fixing the Tailgate, Lock, Hinge assy (Ahh Bumper only thing I touched,,, Unless I hit her car with a pole Approx 4inch Diam)
also New mudflaps among other stuff
And Painting the whole Tailgate and side pannel
Grrrr
it is a 92 Barina
and the only damage on my Bedford Van (Newly Painted) is scuffing on the bumper, Left side and about 6inches wide)
SO.. I will let you know how it goes and so will I....
It was NRMA as her insurer, u2u me the Lawyer there using, Is it a Cover letter in Maroon Letter head?
I have talked to the contact there told him the info and said I did not agree to the amount.. (You must be NICE AS PIE, be Realy helpfull and whatever you do DO NOT GET THE SHITS AT THEM, if there rude, ask for the person above them)
they are within there rights to make you pay unless you take it to court, you do not want this and nor do they, it will cost them $2000-$4000 for the first day in court for them any way so they will mediate it and come to an agreement...
Just say YES I did THIS damage and am willing to pay for it...
But I DO NOT accept that I did That DAMAGE to the other car..
you could Half that cost if your lucky..
Keep the channel open and we may help each other out with what best to say and what BEST NOT TO SAY...
Can you proove that you had tryed to contact the other driver, pass that onto the lawyer and say you tryed to contact him to settle the claim with out lawyers..
Anyway this is the longest post in history
Cya
quick! lets all stowaway in the next container goin to rio di janero!
I bumped another car, put a very slight dent in one panel. We swapped insurance details and 6 months later the bill came through: their insurance company wanted me to pay for the panel repair (fair enough) and for replacing the entire rear bumper and also the tail-light assembly, neither of which had been touched! I wrote a polite but detailed letter outlining exactly what I thought was reasonable and what I thought was made-up. They came back to be with a revised bill that was mid-way between their original bill and my estimate. I was still annoyed at having to pay more than was fair, but I paid the new bill to avoid legal action.
I WISH I HAD TAKEN PHOTOS OF THE DAMAGE AT THE TIME!
I EVEN HAD MY CAMERA WITH ME!
Next time I'll take pics for sure.

Just be thankful (unlike myself) that you didn't hit a taxi and they sue your for loss of income as well
You technically have to file a police report when any traffic accident happens (even if your wheelie bin gets hit). So you may be able to go back and file a report now saying what happened, when, where and state the fact that she was on her mobile.
As for contacting her, legally you're not allowed to. If the insurance company has dealt with it, you're only allowed to deal with them. This happened to a friend when they had their car fixed by the insurer, then the guy who was responsible called them and started abusing them because they never contacted him personally about it all. He ended up threatening them and they swung back (legally ofocourse), only a young guy, but still he got hot under the collar and in turn a lot of trouble.
kafer I went into the back of a taxi and found them quiet resonable. It only cost me $420 for a new rear bumper and no other costs.
I have no sympathy for my car, only the wallet that pays for it!
Go hard or go home!!!!
news on the claim front:
spoke to two friends who are studying law, they agree that im getting my leg pulled, and gave me some tips on how to approach the guy and what to say.
spoke to the guy and asked him why he didnt do as we agreed (it was agreed between us at the incident that he would get quotes, and about 3 weeks after the prang he ran into me at work and told me he got a quote from the insurer and that he wasnt going to go for it but was going to get private quotes... etc etc etc) and he was being a real ass about answering my questions. The invoice and single quote that came with the insurance letter was so illegible that i cant tell what im paying for, but i do know that he has claimed for a replacement window and there was no window involved in the accident at all!!
so my friends told me to contact legal aid at uni, which i did, they informed me to send RACQ a letter stating that many things are unclear in the matter and that they require rectification... which is what i have done.
i'll keep you posted on the rest...
