While driving home from the tip this morning, towing my trailer, a guy in a white ford/commodore came up behind me, overtook me (cutting me off in the process) and flagged me down several hundred meters down the road. (this is in the country) Anyway, he got out yelling and abusing claiming my trailer was flinging stones onto his $10 000 new paint job. The stones he was referring to was a pile mostly of sand about 4" x 12" x 12" covered by a peice of heavy board 6'x4'. I think when i hit the brakes to avoid him, the board moved forward a bit. There was no way they were coming out of the top but may have escaped between the tail gate and the body. He threatened to punch my copulating head and was going to report me to the Cooma police. My only words to him (i let him do all the talking) was to ask him why he didn't back off. But he didn't seem to think he had to. After all was said and done, he got into his car (he took my number plate, i took his to which he replied he wasn't the registered owner) and he reversed toward me, slammed on his brakes, dropped the clutch showering me with stones and fish tailed off. Unfortunately, his car swerved onto the right hand side of the road, he overcorrected and swung back to the left and drove head first into a ditch.
He was sooo angry i could see him hitting the steering wheel with his fists several times. When he got outto survey the damage i sedately turned around and told him i was heading back to town, would he like me to arrange for a tow truck. You can guess the rest.
After i reported it to the police (by way of a letter pinned to his front door) i went back and videoed the scene etc. (i heard him drive past the station with bits of his car flapping on the ground). i was wondering what do i do now? there were no witnessess other than the passenger in his car who did not get out. what if he says my stones caused him to crash while driving? I live in a small country town and this is all new to me, since i live with the dog (she was no help) i thought i'd ask here.

I wouldn't worry too much about it. If he fishtailed out of either a 'on road position' or off the side of the road then there will be marks of his rear tires disturbing the dirt/bitumen. The cops (if they ever get involved, and I doubt they would) should ask for your version of the story, now if he showered you with stones as well, then you have 'evidence' of your version.
I wouldn't say that you covered your load with a 6x4 board as thats not exactly right either, but from what you have said I would not worry too much. However I would keep your car and trailer out of view from the street for a while and watch out in case he follows you home. (I used to go to Uni with a bunch of folk from Bega and surrounds... and some of them were a wee bit ... well, politely said, strange!!)

Yeah, i agree with penguin. If the police do knock on the door, u shouldn't get busted for anything, they should be able to go back to that road and see the skid marks and marks in the gutter of where the car went, and they should be able to work out what happened with this guy (in the case of him being the one throwing himself in the gutter).
He should have backed off anyway.

If he doesn't own the car then why did he care so much about the $10,000 paint job? Unfortunatly there a lot of weirdos out there. I don't see how you can get into any trouble. Serves himself right for stacking the car, I bet that did more damage to his precious paint

if you can argue the law, then theres no need to argue the toss.
It would be impossible for this joker to find any legal fault in your driving or set up. He ain't the law, and the law aint interested in any personal claim for damage.No harm to a human and in the eyes of the fuzz, my option would be it aint a criminal issue, they'd give him a leaftlet and a number to call for social services to come and read it to him.

That's what the cival courts are for, and to prove this crap, he'd blow 10k in a day, just getting it to court, then you can counter claim for say 50k, and most people, even idiots, would be thinking about going through with cival action.
Assuming he has the money to mount a cival action (and can write with opposing thumbs), first thing he has to do is prove he paid for the paint on the car that was not his in the first place, and that he is liable for the damage. Else that what isurance is for....accidental damange .... doncha love idiots?

I love the justice of him driving into the ditch - guess that front air dam/spoiler/whatever will cost him a few dollars to repaint - much more than any stone chip damage. 😉

if he is claiming that ur load meant he had to swerve...first thing is this...he has to travell far enough back that he is a 'safe distance' .... if the gravel was coming at him...and flew into his car etc...it wasnt a safe distance...only because small gravel would have landed in most cases...before next car cruises....
it like when car in front brakes hard...for whatever reason...and run up their butt....ur still at fault....u need to travel far enough back to cater for sudden braking
but...take lots of pics...showing what road marks etc...
in some cases....police can take ages to shwo up to investigate...my sister had to make a statement 9 months afetr her accident...and only because other guys insurance company pushed them to do it...thankfully we had LOADS of pics to demonstrate what had happened...

Reporting it to the police was the go. They prob wont want to know about it, but he could be dangerous and you'd be doing the right thing. You did the right thing from the outset with this bloke. He had the problem, not you.

You've got nothing to worry about. He was the aggressor - no matter what he reckons was happening. He would have to prove it - which I don't that he can do that. But you've got the video evidence anyway. Just lay low, keep the trailer out of site, and keep having a piss laugh at what is a great bit of Karma.
How pathetic was this guy. Youu have nothing to worry about although I would report the damage he "intentionally" did to your car. Idiots like this will not learn from it, they will just blame you for making them act this way. You can take comfort in the fact the guy got we he deserves though. Even if he doesn't understand it.

thanx a lot guys n gals i do feel a whole lot better having read your replies. i did take video evidence so i have got all that i need etc, unfortunately my car is fairly recognisable around town (quality always stands out) but all things considered i will now go and enjoy an early fathers day picnic with my kids (they are leaving on hols with their mother next week).
