Has anyone on here ever written a business proposal to present to investors and to a bank?

I have a grand idea, and whilst I know it will take some $$ to setup, know that it will take off when up and running. It will be something all car enthusiasts will be able to appreciate.

So if anyone has any ideas on how this needs to be done, please let me know. Ideally, I know I will need to talk to the bank, so perhaps getting a pack from them might also assist.

make sure you legally register/own your idea and intellectual property BEFORE you tell anyone, even your close mates.

I didn't - despite being advised - and trusted a bloke witha grand idea of mine. And now I don't earn ANY money from Australian Muscle Car magazine

Don't you worry Glenn - the only one's who know are my wife, and a close friend who is good with design, and for whom my idea is very close to her heart. Thanks for the tip though.

How do you legally register an idea, and through what means?

I can't remember the name or the site (great help I am already) but isn't there some mob who patent people's ideas, and give them a grant to get it off the ground? I'll flit through the web and see if I find something on it anyway for ya. 🙂

You should look at IP (Intelectual Propoerty) Australia at:
http://www.ipaustralia.gov.au/

Nevertheless, if your idea is something like "a magazine for advertising a particular type of car", for example, you won't be able to gain any protection.

I found the IP one too, but for some reason it wasn't in my post? There should have been 3 more links for you. Oh well, the IP one seemed like the best.

Oh, and when you're a millionaire, I'd like an immaculate black Type 3 wagon with a Suby engine and all the accessories. :P

This is great, despite being a complete VW numnuts, this is what I do.

Forst of all I should disclose I am a lawyer. Sorry about that :-) I don't write business proposals, but I act for a lot of inventors and start-ups. My firm, redchip lawyers, is "boutique", we specialise in this area and help people commercialise innovation - from software, to business systems, to widgits.

We act for Business Angel investors and Venture Capital funds, and do a lot of work with consultants that help people get grants.

Starting and funding a business to commercialise some clever stuff involves Intellectual Property protection, business structuring, protecting your personal assets from the risks of being a director of a start-up business, funding etc.

If you want to havean obligation free chat, head to my website, check us out, then give me a call. Happy to help any way I can.

www.redchip.com.au

Some of the websites listed are good, but it's putting it all together the right way that counts.

Best of luck!

Thanks guys for the links so far - there is so much to do. What I am looking at is not an invention, but a outlet specialising to a particular type of clientel. Should I still put the idea down and protect it in some way - as from my investigations, it does not exist in Sydney (I don't know about the rest of Australia) that I know of. But....it has been done before for up to 50 years in the U.S.

I haven't had to write a business plan for a bank but I have had to write an operational business plan for the finance dept at work to try and squeeze some money out of them for patient equipment. My advice is to do your research and have supported evidence that your plan is a viable option

I am off to a business advisor on friday. Ist hour free so I am going to get a list of questions and time the hour. After that it is $240 an hour. Main question is the possibility of a business direction grant so I can get some business advice courtesy of the government. Getting the idea clarified is beneficial and if it makes money and tax then the government can pay for the nitty gritty.

bottom line with a plan ... the bank does not care how much you make, there's no massive upside for them in the short term. It's risk assessment and management. They will give you 100k if you give them 100k security - like your house. They'll give you 5k if you have stuff worth 5k to hand over if you don't pay up.

Business plans are great for you, as it makes you put on paper, the reality of what you are doing, and more helps you to focus on your performance.

You can never save your way out of a crisis. I highly recommend that you get an accountant to look over it, might cost you a few hundred. And look at getting a 'shelf' prepared ACN number as a PTY LTD for a grand. Then if it goes tits up (and thats usually not your fault, but some idiot not paying you etc.,), then it firewalls you and your family from too much agro and it's then very hard for them to come and sell your house....

All depends on the amount of $$$$ you need. Most banks will give you an overdraft if you're in business for some poxy amount.

If you have equity in a house, consider re-packaging your mortguage, as a business loan rate will be significantly higher than a home loan. You should be able to split the loan into multiple accounts. As one way or another you have to give it back, then a business loan for small business is very expensive.

Tread carefully if it's a franchise your doing ... they can be very expensive with lots of catches - defo show a lawyer in that case. AusTrade and Small Business will assist you in R&D money, almost buck for buck in some cases. Talk to the local gov small business department ... there is help for new business, they don't give money as such, but say if you need a specialist to help grow your idea, then they may fund half of the fee for example.

Sorry if you love banks, but over the years I've had businesses with big staff and turnover, banks are good places to deposit money and pay bills, but they are driven by their shareholders need to make money ... and these days they like people with credit card depbt and mortguages, as it's easy money....for small business, you present risk, so no matter how good the plan, they will want to know - how will you give us back our money if it doesn't work out...

Get as much advice as you can mate.

Please correct me if I'm wrong, but someone once said that a way of protecting intellectual property is to registered post it to yourself and leave it sealed.... I dont think this would be foolproof...it might be a cheap option to start with though

I sent PM on this-it is a great way to go initially-many musos do this when they write something to protect it before they record.

This is a good way to prove (and date) authorship and thus enforce your copyright rights, particulalrly applicable to things you author, e.g. song lyrics & music, computer programs, articles and works of art. However, it does not provide general "intellectual property" protection for ideas.

For example, I can write:

"It would be a good idea to set up a mobile Volkswagen lowering service called Bug-Slam-Mobile".

The words I wrote are my authorship and are protected by copyright; except for some 'fair use' provisions of the act, you can't reproduce these words without my permission and, possibly, remuneration. However, nothing prevents you from setting up a mobile Volkswagen lowering service called Bug-Slam-Mobile, unless I have registered that trade name (I haven't; go right ahead).

Even if I have registered the name Bug-Slam-Mobile, nothing prevents you from setting up a mobile Volkswagen lowering service called VW-Slammo_Comes-To-You, because my idea is not *patentable*, for a number of reasons including that it is not novel (think Lub-mobile) and it is obvious (it's just an extension of exisiting business practices into another area of coverage).

No matter how brilliant squizy's idea is, he will have difficulty in obtaining IP protection for it, as ideas are difficult to protect. Business advantage can come from a number of other potential advantages of being first to implement an idea, such as early capture of a controlling market share, barriers to entry, pure novelty etc., but are less likely to be found in the form of legal protection for IP.

Based on this information, I don't need any IP protection of any sort. I just need a good solid business plan that will help get me the funds to put everything in motion. There is nothing in place to stop anyone else doing what I want to do, but to be the first in the market is what should be the clincher.
