my type 3 got rear ended a few weks ago, not to badly but bad enough for me to go to a pannel beaters to get a quote. Got a qoute and now the guy who hit me is refusing to pay, claims I am ripping him off and that the cost of repair is more than the car is worth (cost is $550), and best of all, "how can It cost so much the car is older than you and your not even an australian".
True im a Scot with residency, and yes my car is older than me, but FFS!
It was the only dent free panel in the car!!

hmmm... methinks this guy is being 1)a weasel and 2)racist!
tell the F**ker to shut up, and if he didnt want to pay then he shouldnt have rear-ended you... he rear-ended you, he pays the monetary consequences.
take it up with his insurer.
also, chances are he isnt even australian... unless hes an australian aboriginal. so the little argument about your being an australian can go get stuffed too!
in the beginning, the universe was created.
this made alot of people very angry and is widely regarded as a bad move.

That sucks, $550 isnt that much for panel repairs anyway. What a tight arse. I'm sitting on a quote right now for a bunch of small repairs on my work car (work pays) like carpark dents etc its nothing major but it is costing $1800 ish, so $550 for crash repair sounds like a good deal to me. Thats a cool idea to tell the cops he did a runner, when they chase him you can bet he will pay up.

I had a similar problem years ago where the guy got some legal advice and decided that all he could afford was $10 per fortnight so he would pay it off over a number of years in that way. Fortunately I was able to get insurance to pay for the repair then they got it out of him. Its not much fun though, good luck

Simply let the twit know that if he doesn't like $550, you can make it more by going through the Small Claims Tribunal. By doing this, you can get a couple of higher quotes, submit only them with the small claim, and when he brings up the quote of $550 in court and the magistrate (referee) asks you about it, you can boldly and honestly state "he refused to accept the first quote".

It's pretty much guaranteed if they don't award one of the new quotes outright, they will name a sum half way between the lowest and highest (including the original one) and then ask you if you're okay with that. In the end, you win, he loses, and you get to rub salt in his wounds. And on top of that, when you go back to the $550 repairer, you can use the extra cash he has to give you to go have a nice dinner, a few drinks, and buy some more shiney bits for your car...

Oh, and he gets to pay for your small claim too.

Totally agree with last celtic warrior. I had to threaten to do this to my insurnace company when they refused to pay on the grounds of "Significant inconsistency in material facts". After several months of fruitless phonecalls and letters to the insurer, i ended up paying a solicitor to send a letter demanding they explain this "Significant inconsistency". The answer: I stated on the claim that the accident happened Sunday night, the police report said Monday morning. The accident happened at 12:15 am Monday.

When I received this info, accompanying it was a statement from the insurer that they had reversed their descision and had decided to cover the car but write it off. Once I explained to them that I had waited 4 months for them to accept their mistake and had already started repairs on the car out of my own pocket, they stated that this was not their problem. One more letter from the solicitor threatening legal action and guess what? They covered all repair costs plus my 'inconvinience' fees (phonecalls, travelling costs etc.).
A POSSE AD ESSE.

I live in my own little world, but it's okay, they know me here.

Actually, I rear ended someone about 6 years ago. Massive collision, my car went under hers. Mine was a writeoff, hers was about $3,800. Her insurance company hit me up for the money, then tried debt collectors, but...

I took the lady through the small claims court and won, she (her insurance company) had to pay me for my car and that was the end of it. Until I rang her arrogant insurance company, spoke to the person that had harassed me and asked them "How does it feel, huh? How does it feeeel?". They went silent... LOL

The catch with this one was, the lady performed an emergency stop in the middle of a bridge on a highway. She admitted to not knowing if anyone was behind her, and misreading a sign before the bridge and not being sure what she should do. One reason I pushed this one through, apart from the money issue, was to prove just because you run up the back of someone, doesn't make it your fault.

With the case in this thread though, whip his butt till it bleeds (in court).

tell him your going to give him a choice the easy way or the hard way. the easy he pays what it costs, the hard go through the small claims court and it will cost him more money on top of the other amount
