Hi there,

A couple of quick points as to Aussieveedubbers' status.

Re-iteration of our forum rules

In the next week or so, you will be required to re-affirm your acceptance of our forum rules. I am pretty sure they will not be changing as they have served us well.

The thread suspension issue which has caused a lot of pot stirring recently is directly related to the rule you have already agreed to, which states:
You agree, through your use of this service, that you will not use Aussieveedubbers to post any material which is knowingly false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, or otherwise a violation of any law. You should be aware that in some circumstances material could be defamatory (libellous) even if true or even if a party is not named but can be reasonably deducted from information given.
We don't do this to be kill joys - we are just complying with a bad Australian law. The direct application of lawyers and defamation law has killed some very successful forums (overclockers, a hot rods forum to name two off the top of my head). We do not want a post from any member to KILL us. If you want a forum, you simply don't do this to your community. That's why it's in the rules.

Any thread doing this will go bye bye without warning. We will endeavor to U2U the thread starter with the news. Seriously, if you start a thread which can go either way or has already crossed the line, expect it to disappear. Due to bugs in this software, it is MUCH safer not to delete individual posts or threads. We simply move offending threads to a hidden protected area. They're not gone, but they're very likely not to come back, either.

This is nothing against anyone in particular, and it is not censorship. It's iron fisted adherence to Australian law. If you don't like it, go see your local member and complain. I'm sure they will not care as many of them get nice swimming pools and snazzy holidays for their entire family from defamation settlements. They're about as likely move on defamation reform as a Frenchman who lives next door to a brothel. (Apologies to Black Adder).

Support of late, and what's going to happen to improve it

As many of you know, things have been a little slow due to e-mail and support issues.

This is due to:
  • Our dedicated server is blacklisted by various spam vigilante organizations and there's no way to get off them - despite asking the AFP / AHTCC to get these morons to comply. This means we must move to another server provider and hopefully this time we will not be blacklisted again. Although these asshats have financially and materially damaged us, and we're effectively paying extortion money in order to be able to send e-mail, there's nothing we can do - not even sue them for damages or get them charged under Australian computer crime law.
  • The forum software we are using is beta quality, and does not send e-mail properly. I no longer have the time to write it or keep it up to date.
  • We do not have enough technical admins. See below.
So here's what's going to happen...

Resetting the mail support queue

It's just too many requests for me to handle right now. I am going to delete any requests prior to Jan 1 2007. If you still need help and haven't received it by the end of this week (Feb 10), please use the "Contact Us" button to ask for what you need again.

My apologies for this - I literally have too little time to do everything I want to do, and something has to give. In this case, it has been the support queue and the quality of this software.

Moving to a new server with new production quality software

We will be moving *just* Aussieveedubbers to a new server, hopefully to an IP address space which is not blacklisted by asshats. This might happen relatively quickly as our migration is not dependent on changing the software. You should not notice much in the way of downtime.

We will be moving from UltimaBB beta 2 and a bit to vBulletin 3.6.4 by the end of the month. I have to buy a license, and write and test the importation utility to convert our forum to that software. The new software has its own portal software, and that may be used as well. These unknowns may impact the end of February delivery date as I simply don't have the time I once had.

I will be making a test board available for folks to play with in the next couple of weeks or so, with either a blank or a test import of data. If you want to test the new software, please let me know.

Want to help be a sys admin / support manager?

If you are technically bent (particularly if you're a Linux geek or a sys admin in your day job) and have some standing in this community, U2U me directly and we'll discuss how you can help with processing the support queue and other sys admin tasks. The pay sucks, btw. As in there is none.

Nothing to do with what's above, but *pulls on Mr Marketing hat* with new software etc, will it be possible to give the site a bit more of a Veedubby feel on the home page? It's already a popular site, but a few more international visitors/members could be good...?

its only defamation if it is untrue and unjustly tarnishes someones good name.

the workaround on overclockers was to allow a link to a file hosted elsewhere, just a text file of those you have dealt with hosted on your own ISP web space and detail your dealings there. Theres always the heatware option.

Vanderaj, good move going to vBulletin, make using this forum a bit more appetising. keep up the good work and good luck with the move.

What a crock of frog shit.

I can delete an individual post, so long as it's my own. I can delete this post this time next week.
Do you honestly expect me to believe, with the superior access admin & the mods have, that you can't?

But that aside, you will not convince me that EVERY deleted thread has fallen foul of the rules. The ones actually naming a business would be in the absolute minority.
I would go as far as saying 50% of deleted threads start out with "what happened to my thread?"

What I'm proposing eliminates that question to start with.
What is the problem with a mod locking a thread with a post explaining why? Then there's no questions. I can't see why this is such an issue.

Right here right now, two posts appear at the bottom of a topic that you are obviously familiar with. MINE.

One has something to say about subaru powered VWs & his mate joins in & names to people that own such a vehicle. Names!! Not user names.

I would have no trouble with that disappearing off the end of my thread.
But your saying that to do this you must penalise me, & anyone else who has written a legitimate reply, because of two clowns completely off topic.

You've been telling me for years how clever you are, you have to be able to do better than that.
Well my friends are gone & my hair is grey, I ache in the places where I used to play.

to whom ever has an interest.

i am in agreeance with spook.

surely it is jsut as easy to delete a post only, as it is a thread. and even jsut as easy or respectfull of fellow AVD users to insert a little 'who and why' so as not to leave people wondering or annoyed. in particular if you start a legitimate thread with the right amount of detail and some fool deteriorates it. (and unfortunately as this forum has gotten larger you unltimately get more fools.) the ability to 'discuss' a topic on here is becoming dead in the water. after all you can only have discussions with opinions from both sides. what good is a thread if its a one person post and then thirty five agreeances, or little smilie thumbs up! you need to be able to talk about topics. if someone is going to head off track it is better to let that person know with an edit to his post than a delete of hte thread.

ive noticed so often on this forum that the buddy buddy group can post how they like. leave out things like price, details or make comments not related to or talking up a thread, and they will get fellow support from mods, who at the same time will come down on another AVD member who isnt in the 'inner circle'. after seeing so much double standard, and the goings on, like the above that spook mentions, it all jsut makes me, and i am sure (and know) others to want to be less interactive. and of course with a decline in interaction you will get a decline in the forum... or hte quality of the forum.

for interest... i am a member of a motorbike forum, netrider. maybe take a moment and check that out. they will mod your post if not right, and tell you why for future reference. they will warn you and then ban your thread/post if not good. but at least thier members have a fair idea of where they stand.
but take a closer look, and you will see negative and positive threads of dealers, suppliers and fellow users. go figure. either they are not affraid, or not concerned or maybe the motorcycle community is more tolerant and supportive of their co riders... either that or the VW community is jsut becoming full of many nasty wnkrs (or they dont like that they can not continue their same behaviour) who are not only happy to rip people off or fail on thier words, but defend their right to do so with lawsuits; or the ego driven 'enthusiasts' who jsut believe they have the be all and end all of this hobby and therefore further push a limited passion to the obscurity of jsut saying comments like... 'yeah mate, nice ride, love the pink.' or ' what did you do on sunday?'.
this forum should be about community, community learning and community support. it should be about looking out for others and passing valuable knowledge on, both good and otherwise. it was once! and i, being another aussie member ripped by another vw enthusiast knows, that this forum, even though more members, is less today than a few years ago, and seems to jsut continue to spiral down.
soon it will just be 'secret hand shake' or 'let me stroke your ego crap'. rather than the once the great forum that was able to support members with honest and open and usefull questions, answers and experiences.

please, after reading this. dont get me wrong... i appreciate, and have always, this forum and hte work that people like andrew and others do. it is a great effort and i can honestly say that many of you have my respect for you efforts. but i, like spook, would jsut like to see a use of consistancy, respect and justifiable management.

wes.

Well that is a mature way to treat fellow AVD members!

Would the forum still be "run within the bounds of Australian law" if ONLY the offending post(s) were deleted, as opposed to the entire thread(s). That's a major part of what is being asked of the mods.

Well, your managerial style hasn't changed. I'm surprised.

I was here long before you sunshine. I'll be here when your gone. Every reign comes to an end.

But, if you want to play "Let's quote the rules";
--------------------------------------------------------------
Any member whom feels that a posted message is objectionable is encouraged to contact us immediately by email. We have the ability to remove objectionable messages and we will make every effort to do so, within a reasonable time frame, IF we determine that removal is necessary. This is a manual process, however, so please realize that we may not be able to remove or edit particular messages immediately.

Although this forum does not and cannot review the messages posted and is not responsible for the content of any of these messages, we at this forum reserve the right to delete any message for any or no reason whatsoever.
--------------------------------------------------------------

I count the word "message" 6 times.
Thread or topic, nil.
It actually says it should be done the way I'm asking for it to be done.

These are the rules, if you don't like them leave.

Which brings me quite neatly to this;
-------------------------------------------------------------
In the next week or so, you will be required to re-affirm your acceptance of our forum rules. I am pretty sure they will not be changing as they have served us well.
-------------------------------------------------------------

Yes, they have served us well, despite there still being interpretation problems. But I was happy with them when they went up & still am.

BUT, with the self inflating title of "Super Administrator", your being "pretty sure" of no changes is nowhere near good enough.

You either ARE sure or you ARE NOT.
When you have the ability to alter the rules (notice I didn't put 'god given right'), there can be no neutral ground.

I trust that if any changes be deemed needed, that said changes will be put up for scrutiny & comment by the 7000 odd members who aren't vanderaj, BEFORE they are implemented.

56astro,

In a crowd of 7400+ odd members, if I can get along with 99.99% of them, that suits me fine. I don't need to be friends or friendly to those who are hostile to me for no reason. Those who know or have met me, know that I'm a reasonably friendly, chilled out individual, and so to hate me without ever have met me is just stupid.

A few special folks always cry "censorship" or "why me" when this topic comes up. I am done with arguing with these few special folks, and have been for some time.

Now to answer the meat of your question, which is perfectly valid:

WARNING TECHNICAL CONTENT: The software has post deletion bugs. I know this cos I coded it. The database schema requires transactions to perform post deletion safely, particularly the first post (which is often the offending post). The database server we use (MySQL) does not support transactions. Thus if a member posts to a thread which is being re-organized by the moderation tool after the first or last post is being deleted will end up with a dead, orphaned post and a dodgy thread which will crash the software. When it's quiet, post deletion can be performed safely. When it's busy, or the thread is being edited or moderated, it's extremely dangerous to perform post deletion. However, data corruption is now a minor thing, as the software has a set of fix tools which can resolve the problem, given enough time. It just means a few hours offline whilst we run a tool or three over it.

More importantly, as a admin under Australian law, Brad, Jim and myself are ACTUALLY liable as the *content hoster & publisher* for the posts you folks make. We protect you from ISP take down notices. We protect you from lawyer bullshit. We protect you from stupid letters sent by bush lawyers. We make sure there's a forum to read.

As we have responsibility, we set the rules. We updated them last in 2005 in consultation with all the current members, including those few special folks I was talking about above. That's why I don't care - we've been here, done that. Nothing has changed in Australian law or how quick to anger some members and external businesses are. We've banned one or two high profile users who really should be here as they have a wealth of experience. Many folks are good friends with them, and use them for their VW's and engines. But we had to ban them because they tried to destroy this place.

I don't care to pay lawyers any money at all. The OC and hot rod guys paid a lot in terms of angst and money to get back online (more than $20k). That could have been used for other things. We have dodged the bullet about 10 times so far, and I'm so sick of the shit that happens every few months, it's not funny. I know Jim nearly walked away a little while ago over this exact issue.

These threads cause more than 95% of our problem reports, and thus make all of us (about 15 or so of us) jump and respond. You know what? It's just easier to move the entire thread to a safe place. It takes a few seconds and a few threads from the above special folks.

The rules are here to protect this community. If folks want to ignore that, good on 'em, they can create their own little community and pay the $20k - $500k in legal fees for a full court battle every time, hundreds of dollars in phone calls all hours of the day, months in arbitration and in court, apologies when no apology should be necessary (or given), and moving servers when your ISP takes you down when they get take down notices from yet more lawyers. Or do what we do: get rid of the problem before it is a problem.

This is not about censorship; never has been. It's about making sure we're here today, tomorrow and next year. I'd rather spend the few hours per week I have free now on things that help build this place than spend one single second with a scum sucking lawyer. I can do that (in fact, we all can do that) if we simply say:

NO POTENTIALLY OR ACTUALLY DEFAMATORY POSTS OR WE DELETE THEM.

It's that simple, it's in the rules, and we do it.

The easiest protection, and rock solid legal protection to boot has been mentioned by me in the past. It has also been explained to several people in "admin / mod" positions.

After the legal threats (which were all piss and wind, but still damaging) on the rodders forum we moved to servers owned by an American free speech organisation. The administrators are American and as such can refuse to hand over any detail regarding the members of the board - pretty hard to sue someone you can't identify! It doesn't matter even if you use your real name, there is no proof you wrote anything until the publishing site provides some information as to the source.

They look after the legals, and even the cost of the bandwidth and hosting and even assist the local "technical" admins. Why? because they care about free speech and we have a forum where the fat old bastard that tried to sue a bunch of our members can kiss our arses.

I agree, follow the rules, or leave... its pretty simple.
The samba used to be a good site 6 or so years ago, now its full of banter, put downs, and stupid smart ass remarks. I think its better to keep AVD pleasant and use it for what its intended, the VW community.
Some people put in a lot of effort to keep it going, for the benefit of everyone. I see no reason why one peron should be allowed to mouth off and be the reason it is no longer.

On a different note Andrew are you going to Bugout in Manassas, Virginia this year?? Is it pretty close to you?
Im heading down from RI with some guys from here...

I don't hate people I've never met Andrew & I believe you'll find that written in a thread some time in the last two years.
I find it very narrow minded that you would think that way simply because some people won't follow you like a lost puppy.

Your a f#cking annoyance, without doubt.
The difference between the forum & knowing someone socially is, what you do at a bbq wont affect me.
What you do here does.
That gives any member the right to ask questions.
As I've also "said" once or twice before, we are members, not disciples.

These "special people" , through their input, helped come up with the final draft of what are now the rules, as opposed to the dog's breakfast initially offered up.
I haven't forgotten. Neither should you.

I have also not forgotten a post when you were first made a moderator. Words to the effect; that asking the opinion of the members about any proposed changes was a waste of time.

That single comment Andrew, has led me to scrutinise everything you do. Nothing to do with like or dislike.
A comment that I might add, was hastily deleted.
Strange that you knew how to do it then.

I don't know if this is a solution as obviously there IS a technical reason why individual posts are not deleted, however mods do have the ability to edit individual posts as well.

I've done it before, but maybe if there is an offending post (but the thread itself does not warrant suspension), mods can just edit the content out and U2U the author of the post to explain why (eg. "your post was edited as it contained abusive material").

I think it is important to U2U the "offender" and let them know why it was edited, however I don't think it is appropriate to give the explanation to everyone (by writing that message "your post was edited as it contained abusive material" in the actual post).

Maybe this method of editing rather than deleting individual posts can avoid the technical hiccup that occurs for an individual post deletion, but still allows the necessary moderation of the post without suspending the entire thread.

I don't know if it will work - I'm happy to use that method however there are only so many active mods and so many posts to review = so we still rely on members reporting posts which they feel are inappropriate. To be honest this entire ordeal has made me consider hanging up my moderator hat. I come on AVD for enjoyment, so hopefully some of that enjoyment can return soon.

Good luck, hope it all is sorted sooner than later.
